General Terms and Conditions of Sale.

1. Purpose.

These General Terms and Conditions of Sale, in accordance with current legal regulations, establish the conditions governing the online sales processes on this website, by the user Customers, of the products offered by TORELLÓ. (The Sales Service).

The Sales Service offered through the Website is exclusively aimed at user Customers who are individuals, for their personal consumption, residing in Spanish territory (except Canary Islands, Ceuta, and Melilla) and who are over eighteen (18) years of age. (The user Customers).
By purchasing products through this website, user Customers automatically adhere to these General Terms and Conditions of Sale.

2.- Purchase Procedure and Product Delivery.

To carry out the sale of the Products, user Customers must provide the essential data to process their Orders, which will be requested on this website.

All Orders are subject to Product availability.

Orders can be modified or canceled by user Customers before their respective shipment by contacting TORELLÓ via email at comandes@torello.es. In the event that the specific Order has not already been shipped, TORELLÓ will fully refund the corresponding amount of that sale.

TORELLÓ will deliver the Products to the delivery address provided by the user Customer, always within the Spanish territory, except for the Canary Islands, Ceuta and Melilla, and the Balearic Islands.

The Products will be delivered to the address indicated in the Order, within a maximum period of 8 calendar days from the date of receipt and corresponding payment. However, this timeframe may be subject to alterations due to exceptional circumstances.

If, due to reasons attributable to the user Customer, it is impossible to deliver the Products to the address indicated in the Order, after 1 or 2 delivery attempts with corresponding notifications, the Products subject to the Sale will be left at a commercial branch of the transport agency or at a designated pickup point of the transport agency. In this case, user Customers may choose to have the Products resent, with the new transportation costs being their responsibility.

3.- Price and Payment Method.

The prices of the Products will be as indicated on the TORELLÓ website at any given time. Those prices include the Value Added Tax (VAT) and other applicable taxes.

The prices do not include shipping costs, which will be indicated on the website as well.

When placing the Order, the prices of the Products included in the Order, the Value Added Tax (VAT), other applicable taxes, and the shipping costs will be itemized and displayed. The payment of the Price for the Products subject to the sale must be made in euros.

User Customers must proceed with the payment of the price using a credit card through the online payment platform, which is a secure and encrypted environment where they can enter their card details.

4.- Right of Withdrawal.

In accordance with the provisions of Article 102 and related articles of the current General Law for the Defense of Consumers and Users, user Customers have the right to withdraw from the purchase within a period of 14 calendar days from the day of product delivery. They can exercise this right without specifying a reason and without incurring any additional costs, except for the return shipping costs, which will be borne by the user Customers themselves.

However, the right of withdrawal cannot be exercised when the products have been unsealed, opened, or exposed to unsuitable conditions by the user Customers. In any case, the products must be returned properly protected, in their original packaging, and in perfect condition.
To exercise the right of withdrawal, user Customers must notify TORELLÓ, before the specified deadline, of their unequivocal intention to cancel the purchase of the Products by emailing comandes@torello.es. TORELLÓ will promptly acknowledge receipt of the withdrawal request to the user Customer.

The return of the Products by the user Customers must be made properly protected, in their original packaging, and in perfect condition, within a maximum period of 7 calendar days from the date they communicate their decision to withdraw from the purchase.

The return of the Products must be made through a transportation agent with express courier or parcel service. The products should be sent by user Customers to the following address:

From Monday to Friday, from 9:00 am to 5:00 pm.

The refund of the Price will be made using the same payment method used by the user Customer for the initial transaction unless otherwise specified by the user Customer. The refund will be processed within a maximum period of fourteen (14) calendar days from the date of receiving the returned products.

5.- Warranties and Liability.

The Products are subject to the legal warranty regulated by the applicable consumer and user legislation, and in particular, TORELLÓ guarantees that the Products sold to user Customers through this website comply with the characteristics indicated therein.

In the event of non-conformity of the Products, user Customers will need to return them in their original packaging, and all return costs will be borne by TORELLÓ.

The transportation agency responsible for shipping the goods will collect the package from the address indicated by the customer. This transportation agency will return the merchandise to TORELLÓ.

The return of the Products will be subject to prior examination by TORELLÓ.

In case of claims arising from the purchase of the Products, user Customers can contact TORELLÓ via the email address comandes@torello.es.

TORELLÓ shall not be held responsible under any circumstances for the consumption carried out by user Customers or third parties to whom the alcoholic beverages purchased through this website are delivered.

6.- Legislation and Jurisdiction.

For any matter or divergence that may arise in relation to this website and/or the activities carried out therein between TORELLÓ and user Customers, expressly waiving any other jurisdiction that may correspond to them, they expressly submit to the application of Spanish legislation, with the Courts and Tribunals of Barcelona being competent, unless the applicable legislation imperatively determines another jurisdiction or different legislation.
